Temporary residence permits
A foreigner looking to stay in Poland for more than 3 months may apply for a temporary residence permit. A temporary residence permit is granted for the time necessary to achieve the purpose of the foreigner’s stay in Poland; the period of the stay cannot exceed 3 years, but the foreigner may apply for another residence permit.
- The main reasons for which a temporary residence permit may be issued are:
- carrying out work,
- operating a business,
- bringing a family together,
- staying with a citizen of Poland,
- studying,
- completing an internship,
- volunteering,
- doing academic or scientific research,
- other (e.g. an informal relationship).
Permanent residence permits
A permanent residence permit is open-ended. This means that the permit is issued for an indefinite period of time and the only obligation of the foreigner is to replace the residence card, which is valid for 10 years. A permanent residence permit entitles a foreigner to carry out work in Poland without having to hold a work permit (i.e., the foreigner has free access to the job market).
Residence permits for long-term EU residents
A residence permit for a long-term EU resident is open-ended. This means that the permit is issued for an indefinite period of time and the only obligation of the foreigner is to replace the residence card. In this case, the card is valid for 5 years. A residence permits for long-term EU residents entitles a foreigner to carry out work in Poland without having to hold a work permit (i.e., the foreigner has free access to the job market).
Work permits
An enterprise looking to employ a foreigner from outside of the EU, the EEA, or Switzerland should obtain a work permit for that foreigner. There are numerous exceptions from that rule where no work permit is required for a foreigner. Importantly, a work permit authorizes a foreigner not only to work, but also to stay in Poland.
Registration of stay of EU or EEA residents and their families
Residents of EU Member States, European Free Trade Association (EFTA) Member States, and European Economic Area (EEA) Member States (Norway, Liechtenstein, Iceland, and Switzerland) are required to register their stay in Poland if the duration of that stay is more than 3 months.
The right of stay of these persons extends to the members of their families who are listed in the relevant legal regulations.
Transcription (registration) of foreign vital records
Transcription (registration) of foreign vital records is an accurate and literal transposition of the contents of a foreign vital record into the relevant Polish register.
The procedure before the Foreigner’s Office (the Department of Civic and Foreigners’ Affairs) is conducted in Polish. This means that every letter you receive from the Office will be in Polish. Consequently, an immigration attorney will not only assist in legal matters, but will also help to avoid the language barrier during this procedure.
